I have just received the shocking news that Seamus (Scotchy) Kearney has been found guilty of 'murder' by a British Diplock court after more than thirty years. He is now being held in the cells awaiting final submissions. The facts of this case are few and are entirely circumstantial in nature. The single piece of hard physical evidence is a DNA profile of Seamus on a cigarette end found in a public car park where the shooting took place. Wielded on to this was the issue of 'bad character' arising from a previous conviction for attempted 'murder' in which the same rifle that was used to kill constable Proctor was discovered. There was no forensic connection between Seamus and this particular rifle. I was present in the court when the crown admitted that without 'bad character' the case against Mr Kearney was very weak. This is another travesty.
