- I have been disabled since 1998. I was injured at work and forced to retire three months after going on disability. I have been raising my sister in-laws 3yr old (who is now 15) and her 14 year old daughter (who is now 27) since we lost her during the WTC 9/11 attacks. I've also raised two grandson who are now 17. Since then I've had several invasive surgeries. I've had surgery on my back, knee, and foot. I have limited and painful mobility in my neck, shoulder, feet, hips and legs. I have difficulty sitting, standing, walking, dressing myself and dexterity. Just when I thought things couldn't get any worse three years ago due to an incorrect classification the New York City compensation dept. has stopped my benefits. I was classified as "totally/partially disabled" which I find absolutely ridiculous. This classification only protects the corrupt companies from paying out benefits to the injured which they are entitled to, and force them to seek work they cannot perform.
I have contacted and pleaded with the Board, Attorney's, the Media, Governors, and Senators of both New York and New Jersey and judges but no one seems interested in investigating my case which the board closed even after I won the case in the Brooklyn compensation court. The judge agreed that I did not withdraw from work of my own volition. Then the court in Albany overturned the judges decision and cited with the company stating that I had withdrawn myself from the workforce which I had not done. As stated before I was forced to retire because of my injuries sustained at work. I was never able to return to work since I went on disability in August of 1998 something the Board and Attorney's are aware of but refuse to acknowledge.
My pleas to have the case reviewed and all the medical documentation looked at have been rejected and I keep getting told to look for work I cannot perform and they will consider reopening my case. I am a 62 year old women who has difficulty performing most daily tasks. In all honesty in this day and age and economy most companies will not even consider hiring me. These are circumstances beyond my control. I am powerless. There is plenty of evidence to show the extent of my work related injuries and the physical and emotional damage I have suffered as a result but no one is interested in doing anything about this injustice.
The Alliance for the Injured Worker's tells me the Board can do whatever they want to me and I have to accept it because I cannot sue them or continue to fight them. Who are they really protecting here for it is obviously not the injured.
At this point I am starting to feel like the innocent person that is incarcerated and no one wants to hear he is innocent. What does it take for someone to acknowledge that I need help in solving this matter? I am being victimized by a flawed system and no one cares. I ask myself, Is there anyone out there willing to assist? Is it not obvious that if I keep complaining something is definitely wrong with the way my case has been handled?
My injuries are herniated discs of my neck, compress shoulder and hand nerves, spinal herniated discs which required fusion with invasive surgery for which I was opened from my belly button to my cervix and the middle of my back where my bra is tied to the tail bone, loss of motor movement from the hips down and of neck, chronic pain due to injuries, restricted walking, sitting, standing and lifting and emotional trauma as well.
What does it take to get one's complaint heard by those mentioned above?
